Terms of Use

Please read sections 5, 9 and 10 carefully. Kurkik is early-access software provided as is. It can connect to your messaging systems, including production ones, and its sync commands can change them once you approve a plan. Except where the law does not allow it, you use Kurkik at your own risk.

1. About these Terms

These Terms of Use (the "Terms") are an agreement between you and Pavel Bodiachevskii, an individual entrepreneur registered in the Republic of Armenia(taxpayer number 40258354, address Pavstos Buzand Street, 87, Yerevan, Armenia) ("we", "us"). They apply to the Kurkik software and to this website.

By downloading, installing or using Kurkik, or by using this website, you accept these Terms. If you do not accept them, do not use Kurkik. You confirm that you are at least 18 years old and legally able to enter into this agreement. If you accept on behalf of a company or other organisation, you confirm that you are authorised to bind it, and "you" then means that organisation.

2. Definitions

  • Kurkik or the Software: the kurkik command line application, its terminal user interface and MCP server, the Kurkik functionality inside the AsyncAPI plugin for JetBrains IDEs, and their documentation and updates.
  • The Site: kurkik.pavelon.dev, including the documentation published there.
  • Your Systems: the message brokers, queues, schema registries, cloud accounts and other systems you connect Kurkik to.
  • Results: what Kurkik produces from Your Systems, such as topologies, AsyncAPI documents, export reports, diffs and sync plans.
  • Early Access: the period in which Kurkik is offered before a generally available release.

3. Early access licence

Subject to these Terms, we grant you a free, non-exclusive, non-transferable, revocable licence to install and use Kurkik during Early Access, for your own purposes and for the internal business purposes of the organisation you act for.

Early Access builds may change, lose features or stop working, and a feature may never become generally available. A paid edition, if we offer one, will come with its own terms that you accept separately. These Terms never allow us to charge you.

4. Kurkik runs on your side

Kurkik runs on your computer or in your environment. It connects only to the systems you configure, with the credentials you provide. Your broker data, documents, Results and credentials do not pass through us, and Kurkik does not send usage data or telemetry to us.

You are responsible for the systems and accounts you connect, for having permission to access them, and for keeping your credentials safe. Kurkik stores credentials only as references (for example to your operating system keychain, an environment variable or a file), but where and how those secrets are kept is your choice and your responsibility.

5. Production systems and sync

You may use Kurkik with development, test, staging and production systems you are authorised to access. Kurkik reads by default. The sync commands (kurkik kafka sync, kurkik pulsar sync and any later ones) change Your Systems: they can create, change, delete or recreate topics, namespaces, permissions and configuration, and such changes can interrupt the applications that use them or lose data.

A sync shows its plan and writes only after you approve it. Before you approve, it is your responsibility to:

  • read the plan and decide whether it is right for your system;
  • try it in a non-production environment first, where possible;
  • keep backups and a recovery procedure that do not depend on Kurkik;
  • watch the effect on your applications, and stop if something goes wrong.

The snapshots Kurkik takes before a sync, and its revert command, are a convenience. They are not a backup, and they cannot restore messages or data that a change removed.

Kurkik is not designed for systems whose failure could lead to death, personal injury, or serious physical or environmental damage, and you must not use it for them.

6. Results

Results may be incomplete or wrong, for example when Kurkik lacks permission to read something or when a system reports itself inaccurately. Kurkik states what it could not read where it can, but you are responsible for checking Results before you rely on them, and for the decisions and changes you make based on them. Kurkik does not replace your own monitoring, security controls, backups or incident response. As between you and us, Results belong to you.

7. What you must not do

You must not, and must not let anyone else:

  • use Kurkik to access systems or data you are not authorised to access;
  • copy, modify, distribute, sell, rent, sublicense or publish Kurkik, or offer it to others as a service, without our written permission;
  • reverse engineer, decompile or disassemble Kurkik, except to the extent the law expressly allows despite this restriction;
  • remove or change copyright, trademark or licence notices in Kurkik;
  • work around any technical limitation of Kurkik, or use it in breach of the law or of anyone's rights;
  • attack, overload or try to gain unauthorised access to the Site.

8. Ownership, third-party components and feedback

Kurkik and the Site are owned by us and protected by copyright and other laws. These Terms give you only the rights stated in them; no ownership passes to you.

Kurkik includes third-party and open-source components. Their own licences, listed in the notices that come with Kurkik, apply to them to the extent those licences require.

If you send us ideas or feedback, you allow us to use them freely, worldwide and without payment, to improve Kurkik and our other products. Please do not include confidential information or data from Your Systems in feedback; describe the problem or use made-up examples instead.

9. No warranty

Kurkik and the Site are provided "as is" and "as available", with all faults. To the maximum extent permitted by applicable law, we make no warranties or conditions of any kind, whether express, implied or statutory, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, title and non-infringement. We do not warrant that Kurkik will be error-free, uninterrupted, secure, compatible with Your Systems, or that Results will be complete or correct.

The fact that Kurkik is free during Early Access does not take away rights the law gives you that cannot be excluded.

10. Limitation of liability

To the maximum extent permitted by applicable law, and subject to section 11, we are not liable for any loss or damage arising out of or relating to Kurkik, the Site, Results or these Terms, including loss caused by a bug, error, defect, incompatibility or failure of Kurkik, in any environment, and even when Kurkik was used as documented.

This includes, whether the loss is called direct or indirect:

  • loss, corruption, alteration or unavailability of data or messages;
  • outages, interruptions, slowdowns or failures of your systems, services or business;
  • lost revenue, profit, savings, business, contracts or goodwill;
  • costs of recovery, restoration, incident response, replacement services or additional infrastructure;
  • amounts you owe your own customers or other third parties;
  • any indirect, incidental, special, consequential, exemplary or punitive damages.

If, despite the above, we are held liable, our total liability for all claims together is limited to the greater of fifty US dollars (USD 50) and the amount you paid us for Kurkik in the twelve months before the event that gave rise to the claim.

These limits apply whatever the legal basis of the claim, including contract, tort (including negligence) and statutory liability, and even if we were told the loss was possible.

11. What these Terms do not limit

Nothing in these Terms excludes or limits liability for fraud, for intentional misconduct or gross negligence, or for death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law. Nothing in these Terms takes away mandatory rights you have as a consumer or as a person whose personal data is processed. Where the law of your country does not allow an exclusion or limitation in these Terms, it applies only to the extent that law allows.

12. Indemnity

If you use Kurkik for a business or profession, you will compensate us for third-party claims, and reasonable costs including legal fees, to the extent they arise from your unauthorised access to systems or data, or from your material breach of these Terms. This does not apply to claims caused by our own breach or misconduct, and it does not apply to consumers or where the law does not allow it. We will tell you promptly about such a claim and cooperate reasonably in its defence.

13. Suspension and termination

You may stop using Kurkik at any time; these Terms then end for you once you uninstall it. We may end your licence or Early Access generally at any time, and we may end it immediately if you breach these Terms. When the licence ends you must stop using Kurkik and delete your copies. Sections 6 and 8 to 18 continue to apply after the end.

14. Events beyond our control

We are not responsible for failures or delays caused by events beyond our reasonable control, such as natural disasters, war, government action, power or network outages, or failures of third-party services.

15. Export controls and sanctions

You must comply with the export control and sanctions laws that apply to you and to Kurkik. You must not use or transfer Kurkik in violation of them, including to a person or country those laws prohibit.

16. Changes to these Terms

We may update these Terms, for example when Kurkik changes or a generally available release comes out. We will publish the new version on this page with a new version number and effective date and, for material changes, announce them in the Kurkik release notes or by email if you gave us your address. Changes apply from their effective date; if you keep using Kurkik after that, you accept them. If you do not agree, stop using Kurkik.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Armenia, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The courts of Yerevan, Armenia, have exclusive jurisdiction over disputes arising out of or relating to these Terms. If you are a consumer, this does not deprive you of the protection of mandatory laws of the country where you live, or of your right to bring proceedings there where that law gives you that right.

Before going to court, please write to us so we can try to resolve the matter informally.

18. General

  • These Terms, together with the Privacy Policy, are the whole agreement between you and us about Kurkik and the Site during Early Access.
  • If a court finds a provision unenforceable, it is limited to the minimum extent necessary and the rest of these Terms stays in force.
  • Not enforcing a provision does not waive our right to enforce it later.
  • You may not transfer your rights under these Terms without our written consent. We may transfer them to a successor of the Kurkik business, and will tell you if we do.
  • These Terms are written in English. If they are translated, the English version prevails.
